Your privacy is important to LaBa Technologies LLP (“Company”, “We”, “LaBa”, “Us” or “Our”). This Privacy Policy (“Policy”) describes the policies and procedures regarding the collection, use, processing, storage, retrieval, disclosure, transfer and protection of your information, including personal information and sensitive personal data (“Information”), that LaBa may receive through your online access, interaction or use of the LaBa mobile applications (“LaBa App”) or https://labacabs.com/ (the website and LaBa App are collectively referred to as the “LaBa Platform”) or through offline interaction with us, including emails, phones, direct contact, etc., or in the course of providing our services.
The terms “You” and “Your” refer to a Captain (defined below), a Customer (defined below), a Vendor Partner (defined below) or any other user of the LaBa Platform and/or utilizing the Services (defined below).
The term "Services" refers to any service offered by LaBa, whether on the LaBa Platform or otherwise, in accordance with the terms and conditions applicable to you (available on the LaBa Platform).
Capitalized terms not defined herein have the meanings given to them in the terms and conditions applicable to you and available on the LaBa Platform.
Please read this Policy before using the LaBa Platform or submitting any information to laBa. This Policy incorporates and should be read in conjunction with the terms and conditions applicable to users of the LaBa App available on the LaBa Platform.
User acceptance
By accessing or using the LaBa Platform or Services, you acknowledge and agree to this Policy, including any amendments that the Company may make in its sole discretion and post on the laBa Platform from time to time.
Any collection, processing, retrieval, transfer, use, storage, disclosure and protection of your information will be in accordance with this Policy and applicable laws, including the Information Technology Act, 2000 and the rules made thereunder (“Applicable Laws”). If you do not agree with the Policy, please do not use or access the LaBa Platform.
You hereby represent LaBa:
The information you provide to LaBa from time to time will be authentic, accurate, current and updated, and you have all necessary rights, permissions and consents to provide such information to Rapido.
Your provision of information, as well as Rapido's storage, collection, use, transfer, access or processing of such information, will not be in violation of any agreement, applicable laws, charter documents, judgments, orders or decrees.
If you disclose any information to us relating to others, you represent that you have the authority to do so and that you authorize us to use such information in accordance with this Policy.
Definitions
Unless otherwise defined in this Policy, capitalized terms in the Policy shall have the meanings set forth below:
"Captains" means independent third-party vehicle operators or riders who wish to provide services on the LaBa Platform to a user/customer.
"Co-Branded Services" shall have the meaning given to it in paragraph 5(c) hereof.
"Customer" means an individual who wishes to receive the services of Captains or Vendor Partners on the LaBa Platform.
"Device" means the computer, mobile or other device used to access the Services.
"Device identifier" means the IP address or other unique identifier of the device.
"Promotion" refers to any competition or other promotions we offer.
"Personal information" means categories of information that can reasonably be used to personally identify you, including your name, email address, and mobile number.
"TPSP" means a Third Party Service Provider.
"Usage Information" shall have the meaning given to it in Section 3(II) hereof.
"Vendor Partner" means third-party providers offering two-wheeler rental services on the LaBa Platform.
What information do we collect?
Information you give us
Personal Information: We may ask you to provide us with certain personal information. We may collect this information in various ways and in various places in order to provide the Services, including through account registration forms, contact us forms, or when you interact with us. When you sign up to use the Services, you create a user profile. We will only ask you to provide us with the personal information that we need to collect for a legitimate purpose related to our Services and that we need to collect for that purpose.
The information you provide to us includes the following:
Account Information: Create or update your LaBa account, which includes your email address, name, address, mobile number, gender, date of birth, photo, login name, password, banking or payment-related information (as permitted by applicable laws), etc.
Information Stored: When you use our Services, we may collect and store information about you, including (but not limited to) your phone number, address, email address, billing information, emergency contact information, etc., to process your requests and automatically fill out forms for future transactions.
Verification Information: If you are a vendor partner or a captain, we may collect location details, profile picture, call and SMS details, copies of government-issued identification documents like Aadhaar and Permanent Account Number, license details, other details (KYC), vehicle related documents like registration certificate, vehicle permit, fitness certificate, insurance, pollution certificate, etc., user settings, and other documents proving the health or fitness of the vehicle. If you are a captain, we may ask you to capture your live self-clicked pictures (selfies) and upload such selfies to the LaBa platform from time to time to verify your identity.
Background Check Information: We collect background check and identity verification information for Captains and Vendor Partners. This may include collection of information such as driver history or criminal records (where permitted by law), and employment authorization. TPSP may collect this information on behalf of the Company.
Other Apps: If you sign up as a Captain or Vendor Partner, enable features that require LaBa's access to other applications aimed at preventing and detecting fraud against customers.
Other Information: We collect additional information you provide when you correspond with LaBa for customer support or report issues for troubleshooting. We also collect information you may submit electronically, such as when you use messaging through the app, post on any message boards, and provide ratings, reviews, or comments. If you refer a friend, we may collect, store, and use your friend's name and contact information to promote our services.
In addition to the above, you shall not upload, display, share, host, publish or transmit any information that is: harmful, offensive, harassing, obscene, invasive of another's privacy, hateful, racially or ethnically offensive, defamatory, related to or promoting money laundering or gambling, or online gaming that causes user harm, or is in any way unlawful, or promotes enmity between different groups on the basis of religion or caste with the intention of inciting violence, deceives or misleads the addressee as to the origin of such messages, or communicates any false, untrue or misleading information or data, threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign countries, public order or incites the commission of any cognizable offence or obstructs the investigation of any offence or brings into disrepute any other country. Information we collect when you access and use the LaBa app
Transaction Information: We collect transaction information such as trip details, pick-up and drop-off addresses, distance traveled, and payment transaction information (subject to applicable laws).
Location data:
Captains and Vendor Partners: Rapido collects location data on your mobile device when the Rapido app is running in the foreground (when the app is open and visible on the screen) or in the background (when the app is not in use). For captains, LaBa only collects location data when captains have enabled the "On-duty" icon in the Rapido app.
Customers: If we enable you to collect precise or approximate location data from your device. LaBa collects this data from the time a service is requested until it is completed, and whenever the app is running on your device. We use this data to improve your experience with the LaBa app, including to improve pick-up locations, enable security features, and prevent and detect fraud. Even if you have not enabled us to collect location data from your device, LaBa collects location data collected by captains during a trip and links such location data to your account. This enables us to provide you with services such as receipt generation and customer support, and to enable customer safety.
Usage Information: We, our TPSP and vendor partners may use various technologies that automatically (or passively) collect certain information when you visit or interact with the LaBa Platform to obtain the Services (“Usage Information”). This Usage Information may include the browser you use, the URL that referred you to our Services, all areas of our Services that you visit, the time of day, searches and search results, or usage behavior on the LaBa App.
Health-related information: If you are a captain, we may collect certain health-related information and declarations, such as body temperature, symptoms, vaccination status, and other health conditions.
Device Information: We collect information on our own or through integration with third-party applications, which includes technical information and aggregated usage information, and may contain, among other things, your device's device identifier, your preferred language and country site, manufacturer, software, your device model, device type, operating systems and versions, your geolocation, mobile network data, the screens you visit, your touch gestures performed on your LaBa app, your scrolling activity, other actions you perform while using the LaBa app, etc. This helps to improve the user interface and experience on the LaBa platform, and to provide you with software updates, product support, and other services. Any sensitive information about other programs you run on your device, passwords, and activity across other applications is not collected, and all sensitive information is masked.
SMS/Text Messages: When we receive device access permissions from you, we may collect data from SMS/text messages to (i) provide and receive one-time passwords and other device verification, and (ii) to auto-fill verification details when you make financial transactions with us or through a TPSP, in accordance with applicable laws. Except as provided in this Policy, we do not share or transfer SMS/text message data to third parties.
Call Details: If you are a vendor partner or captain, we will record calls you make from the device used to provide services and related call details.
Other information: We collect information about how you interact with the LaBa app and our websites to which the LaBa app links, such as how often you use a particular part of the LaBa app over a given period of time, how much time you spend using the LaBa app, how often you use the LaBa app, the actions you take on the LaBa app, and how you interact with the LaBa app.
Cookies: Usage information may be collected using a cookie. If you do not wish to have information collected through the use of cookies, your browser/app settings allow you to decline or accept the use of cookies. You can disable or manage cookies by setting a preference on your web browser or device. If you choose to disable cookies or Flash cookies on your device, some features of the Services may not function properly or we may not be able to customize the way we provide you with information. The Company cannot control the use of cookies (or the resulting information) by third parties, and our policy does not cover the use of third-party cookies.
Information provided by third parties about you
We may collect information about you from time to time through the LaBa Platform or when providing the Services. In addition, we may collect information from our affiliates, third parties/TPSPs such as technical subcontractors, business partners, analytics providers, search information providers, payment service providers, and publicly available sources such as commercially available marketing lists, social networks, and other related media.
Use of collected information
Our primary purpose in collecting your information is to provide you with a better experience when using the Services. We may use your information that we collect in accordance with this Policy for the following purposes:
To gain access to the LaBa platform.
To verify your identity and/or your capacity under applicable law to provide services through the LaBa Platform;
To closely monitor which features of the Services are used the most, to allow you to view your travel history, rate trips or bookings, and to determine which features to improve for a better user experience, including usage patterns and geographic locations, to determine where we should offer or focus services and/or features and/or resources;
To send a welcome email/SMS to verify your username and password;
To provide the correct app version for your device type, for troubleshooting, and in some cases for marketing purposes;
To help diagnose problems with our computer server and administer the LaBa platform;
To send you only service-related notifications in rare cases. For example, if our services are temporarily suspended for maintenance, we may send you an email. If you do not wish to receive them, you have the option to deactivate your account;
To prevent, detect, and investigate violations of this Policy or applicable Terms of Service or Terms of Use;
To identify and/or detect, investigate and take appropriate remedial action against security breaches or attacks, errors, fraud, money laundering, abuse and other criminal activities;
We will provide certain of your personal information (such as name, pick-up address, and contact number) to the captain or vendor partner who accepts your request for our services so that the captain or vendor partner can contact and locate you;
If you are a customer, we use geo-location information for various purposes, including to match you with captains and/or vendor partners in your area near your location, to provide you with services, to automatically obtain your location when you open the LaBa app, to identify the pickup location for captains, and to allow you to share this information with others for your safety (if you choose to do so through any features we may provide);
If you are a captain, we use geo-location information to accept orders near your location, track the distance of captains to pick up from their location, share exact location for customers' safety, etc. even when the LaBa app is not in use or closed (only when the captain activates the "On-duty" icon in the LaBa app);
If you are a Captain, we may share your name, vehicle number, driver's license number, phone number and/or profile picture (if applicable), and tracking details with our customers in order to provide services;
We may use your Personal Information or Usage Information that we collect about you: (a) to provide you with information or services or to process transactions you have requested or agreed to receive, including to send you electronic newsletters, and to provide you with special offers or promotional materials on our behalf or on behalf of third parties; (b) to enable you to participate in various features of the Services, such as online or mobile entry sweepstakes, contests, or other promotions; (c) to contact you about your use of the Services and, at our discretion, changes to the Services and the Services’ policies; (d) for internal business purposes; (e) for inclusion in our data analysis; (f) for purposes disclosed at the time you provided the information or as otherwise set forth in this Policy;
To enhance your user experience in relation to the LaBa App or Services, including customisation/personalisation of the LaBa App or Services;
To provide you with relevant offers or rewards, based on your consumption patterns;
To enforce our terms and conditions and this policy and to resolve any disputes;
To provide functionality of the LaBa platform, analyze performance, fix errors and bugs, and improve usability and effectiveness;
To comply with applicable laws or requests we receive from regulators, government, law enforcement agencies or judicial authorities under applicable laws, or to comply with our agreement with a third party;
To fulfill our obligations and enforce rights arising from any agreements between us;
Disclose to affiliates, our and their employees, agents and representatives on a need-to-know basis to facilitate the provision of the Services;
To deliver any administrative notices, alerts, advice, notifications and communication related to the use of the Services via social media (including WhatsApp), SMS and other media;
If you sign up to use our Services as an employee or partner of a third party that has an arrangement with the Company, and/or if discount coupons are offered and/or certain promotional offers are provided, the Company may share any information you provide with such third party for limited internal business purposes only; and/or
With your consent, to fulfill any other purposes for which you provide information to us and/or for any other purposes. Please note, we do not use the information we collect from you for targeted advertising.
How, when, and how we disclose information to third parties
We do not sell, share, rent, or trade the information we collect about you, except as disclosed in this policy or at the time you provide the information. The following are situations in which information may be shared:
When you agree to share information with third parties:
When you access third-party links in the LaBa App, you may choose to receive information and/or marketing offers directly from third parties. If you agree to share your personal information, your personal information will be disclosed to such third parties, and any information you disclose will be subject to the privacy policies and practices of such third parties. We are not responsible for the privacy policies and practices of such third parties, and therefore, you should review the privacy policies and practices of such third parties before agreeing to receive such information from such third parties. If you later decide that you no longer wish to receive communications from a third party, you will need to contact that third party directly.
Third parties who provide services on our behalf
We may share the information you provide with our TPSPs, business partners, and agents. Please review the privacy policy of such third parties for more information before using their services on the LaBa app.
We use TPSPs to facilitate our Services and to provide or perform certain aspects of the Services on our behalf - hosting the Services, designing and/or operating features of the Services, tracking analytics of the Services, processing payments, engaging in anti-fraud and security measures, conducting background and identity checks, conducting criminal record checks, providing customer support, providing geo-location information to Captains/vendor partners, enabling us to send you special offers, hosting our job application form, performing technical services (e.g., without limitation, maintenance services, database management, web analytics, and improving features of the Services) or other administrative services. These third parties can only perform the services they perform for you or us and will have access to information, including personal information. We will require each of these TPSPs to ensure the same data protection as us and will impose contractual obligations not to disclose or use personal information for other purposes.
TPSPs that provide analytics-related services can set and access their own cookies, web beacons, and embedded scripts on your device, which otherwise may allow them to collect or have access to information about you.
We use a third-party hosting provider to host the support section of our website. The information such TPSP collects on this section of our website is governed by our policy.
Co-branded services
Certain aspects of the Services may be provided to you in collaboration with third parties, such as credit houses, loan providers, sponsors and charities ("Co-Branded Services"), and you may be required to disclose information, including personal information, to them. Such Co-Branded Services will identify the third party. If you choose to register for products and/or services through the Co-Branded Services, you will be deemed to have consented to the provision of your information to us and the third party. In addition, if you sign in to a Co-Branded Service using a username and password obtained through our Services, your personal information may be disclosed to the identified third parties for that Co-Branded Service and will be subject to their privacy policies and procedures.
Contests and promotions
We may offer promotions through the Services that may require registration. By participating in a promotion, you agree to the official rules governing that promotion, which may contain your specific requirements, including allowing the sponsor of the promotion to use your name, voice, or likeness in advertising or marketing related to the promotion. If you choose to enter a promotion, you agree that your personal information may be disclosed to third parties or the public in connection with the administration of such promotion, including winner selection, prize fulfillment, and as required by law or permitted by the official rules of the promotion, such as the list of winners.
Administrative and legal reasons
We cooperate with governments, law enforcement officials, and private parties to enforce and comply with applicable laws. Therefore, your information (including personal information, IP address, device information, or geo-location data) may be accessed, used, preserved, transferred, and disclosed to governments, law enforcement officials, or private parties to: (i) comply with any applicable law, regulation, subpoena, government request, or legal process; (ii) protect and/or defend against the terms and conditions applicable to your use of the LaBa App or Services, including investigating potential violations thereof; (iii) protect the safety, rights, property, or security of the Company, our Services, or third parties; (iv) protect the safety of the public for any reason; (v) detect, prevent, or remediate fraud, security, or technical issues; and/or (vi) prevent or stop activity that we believe is illegal, unethical, or legally actionable, or to pose a risk to others.
Affiliates and business transfers
We may share information, including your Personal Information and Usage Information, with our parent, subsidiaries, and affiliates for internal reasons, including for business and operational purposes. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner, or operator of the Services or applicable database; or (ii) in connection with a corporate merger, consolidation, reorganization, substantial sale of substantially all of our membership interests and/or assets, or other corporate change, including during any due diligence process.
Market research and other benefits
We may share your information, including your personal information and usage information, with third parties for purposes including, but not limited to, conducting market research/studies, performing data analysis, determining product or service offerings, customizing, improving products or services, or making other benefits/products/services available to you.
Third-party content and links to third-party services
The Services may contain content provided by third parties, and those third parties may collect website usage information and your device identifier when you serve web pages from any online or mobile services to your browser. In addition, when you use the Services, you may be directed to other sites or applications operated and controlled by third parties that we do not control, in which case our Policy will no longer apply. We are not responsible for the privacy practices of any of these third parties. For example, if you click on a banner ad, the click may take you away from the LaBa App to another website. These other websites may send you their own cookies, independently collect data, or solicit information, and may or may not have their own published privacy policies.
If you specifically and knowingly upload, share, or otherwise transmit content from the LaBa App to an email recipient, online community, website, or the public, such as uploaded photos, posted reviews or comments, or information about you or your trip or booking that you choose to share with others through features that may be provided on our Services, third parties may collect such information. This uploaded, shared, or transmitted content will also be subject to the privacy policy of the email, online community website, social media, or other platform through which you upload, share, or transmit content. We are not responsible for the privacy practices of any of these third parties.
Our online and mobile services may include social media features, such as the Facebook Like button, and widgets, such as the "Share This" button, or interactive mini-programs that run within the LaBa app. These features may collect information, including your IP address, photo, and the page you visit on our online or mobile services, and may set a cookie to enable the feature to function properly. Social media features and widgets are hosted by a third party or are hosted directly on our online services and/or the LaBa platform. Your interactions with these features and widgets are governed by the privacy policy of the company that provides them, and we are not responsible or liable for any acts or omissions of such third parties.
In particular, please note that some third parties may be located or have facilities in another jurisdiction, and therefore, if you choose to proceed with a transaction involving the services of a third-party service provider, your information may be subject to the laws of the jurisdiction in which such service provider is located or its facilities are located. We encourage you to be careful when you leave web pages or links that control the LaBa App/Services and to read the privacy statements of all third-party websites and applications before submitting any information to such third parties. We will not be liable for any acts or omissions of third-party service providers.
Information collected by captains and vendor partners
This policy does not cover the use of any information about you by Captains or vendor partners when providing transportation, delivery, package or rental services to you, or otherwise.
Change of information and account cancellation
It is your responsibility to maintain the accuracy of the information you submit to us, such as your contact information provided as part of account registration.
If your personal information or the information you provide to us changes, or you no longer wish to receive our services, you may correct, delete or amend the information by making a change to our member information page or by contacting the Complaints Officer via the email address mentioned on the LaBa Platform. We will make good faith efforts to make the requested changes to our then active databases as soon as possible.
You may cancel or modify the communications you have chosen to receive from LaBa by following the instructions contained in an e-mail or by logging into your user account and changing your communication preferences.
If we find it difficult to provide you with access to our Services due to the inadequacy/inaccuracy of the information when you modify or change the information previously provided to us, we may, at our discretion, terminate your access to the Services by providing a written notice to your registered email address.
If you wish to cancel your account or request that your information no longer be used to provide you with services, please contact us via the email address indicated on the trip bill you received, the Rapido Platform or the Complaints Officer mentioned in this Policy. Please note, if you disable access to any of your information as described under this Policy, we may not be able to provide some or all of the Services.
We will retain your information, including personal information and usage information (including geo-location), for as long as your account on the Services is active and necessary to provide you with the Services. Even after your account is terminated, we will retain some of your information, including personal information and usage information (including geo-location, travel history, and transaction history), for 180 days to resolve disputes, terminate any actions related to account cancellation, investigate or prevent fraud and other improper activities associated with your account, enforce our agreements, or for other business reasons. After such period, we may delete your data from our database or anonymize and aggregate it, and we may retain it for as long as we need it to effectively provide our Services, but our use of anonymized data will be for analytical purposes only.
Security
The information we collect is stored securely in our databases, and we use standard, industry-wide, commercially reasonable security methods such as encryption, firewalls, and SSL (Secure Socket Layers) to protect your information. However, no matter how effective the encryption technology, no security system is impenetrable. We cannot guarantee the security of our databases, nor can we guarantee that the information you provide to us will not be intercepted while it is transmitted to us over the Internet or via wireless communications, and any information you transmit to us is at your own risk. We recommend that you do not disclose your password to anyone.
Children's information
We do not knowingly solicit or collect information from children under the age of 18. Use of the LaBa app is available only to individuals who can legally form contracts under applicable laws.

We reserve the right to update/modify this Policy from time to time to reflect changes in our information practices. Any changes will be effective immediately upon posting the revised Policy on the LaBa Platform. If we make any material changes, we will notify you by email (sent to the email address specified in your account) or via a notification in the LaBa App prior to the change becoming effective. We encourage you to review this page periodically for the most up-to-date information about our privacy practices. Your continued use of the LaBa App or provision of the Services after the updated Policy becomes effective constitutes your acceptance of the updated Policy.
